THIS VACATION RENTAL AGREEMENT (this “Agreement”) is entered into by and between COASTAL ACCOMMODATIONS and the undersigned guest (“Guest”) and is dated effective as of the last date of signature hereto.

WHEREAS, Guest is delivering simultaneous with the execution of this Agreement a deposit to Coastal as set forth below to secure a short-term rental of one or more properties managed by Coastal and more particularly identified below (collectively, the “Property”); and

WHEREAS, Guest and Coastal desire to enter into this Agreement to set forth certain agreements with respect to the rental of the Property.

NOW, THEREFORE, in consideration of the deposit, the mutual covenants and premises herein and other good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, the parties hereby agree as follows:

TERMS AND CONDITIONS

Guest hereby accepts and agrees to be bound by the Terms and Conditions attached hereto. Coastal may adopt, alter, amend, or modify in the future the Terms and Conditions, which may be posted on or about the Property and on a website or websites on which the Property is advertised. Guest hereby agrees to comply with all such terms and Conditions as they may be amended from time to time and Guest acknowledges and agrees that he or she is responsible for ensuring that all of Guest’s invitees comply with such Terms and Conditions. Failure of the Guest to abide by the Terms and Conditions shall constitute a breach of this Agreement. Should there be any inconsistency between a term of this Agreement and the Terms and Conditions, this Agreement shall control.

TERM OF RENTAL

Coastal hereby leases to Guest, and Guest hereby rents from Coastal, the Property for the term commencing on {reservations.startdate} and expiring on {reservations.enddate}. Unless otherwise specified, the time of commencement of the term on the Check-In Date is after 4:00 PM, local time at the location of the Property, and the time of expiration of the term on the Check-Out Date is prior to 9:00 AM, local time at the location of the property, unless otherwise agreed upon by both parties. To the extent Guest remains in possession of the Property after the Check-Out Date, Guest shall be liable to Coastal for additional rental charges at the rate of One Hundred Dollars per hour after a grace period of thirty (30) minutes, which late charges Coastal may be charged against the primary credit card on file or any other type of credit card provided for payment hereunder.

RATES

The rate for the rental of the Property during the term hereof shall be clearly advertised, plus any other applicable tax, and shall be paid in full in advance by credit card or in such other manner agreed to by Coastal, as set forth below (the “Rental Rate”). All reservations will be subject to a 4 percent service fee, 9 percent Virginia Beach Transient Lodging Tax, 6 percent State Tax, and $2.00 per night Virginia Beach Transient Lodging Nightly Tax.

Rates are quoted per night, per week, or per month basis as noted. Rates are quoted per house dependent on bedroom count (1 bedroom, 2 bedrooms, 3 bedrooms, 4 bedrooms, 5 bedrooms).
 

RESERVATIONS AND PAYMENTS

An advance payment equal to 50 percent of the Rental Rate (the “Rental Deposit”) together with a signed copy of this Agreement must be received and approved by Coastal to confirm any reservation. The Rental Deposit will be applied toward the Rental Rate. Final payment, consisting of the remaining balance of the Rental Rate and any applicable fees otherwise specified herein, must be received by Coastal at least thirty (30) days prior to the Check-In Date (or immediately if booked less than thirty (30) days in advance of the Check-In Date). Failure to make final payments on a timely basis will make reservations subject to automatic cancellation.

DAMAGE DEPOSIT, PROPERTY PROTECTION PROGRAM, AND WAIVER.

Guest shall be liable to Coastal for any and all damage to the Property caused by Guest or its invitees. At the time of posting the Rental Deposit, the Guest shall pay Coastal a $59.00 fee for a rental damage protection plan to cover unintentional damages (not including pet damages) to the Property that occurs during the rental term, provided that such damages are disclosed to Coastal prior to the Check-Out Date. This fee considers risk mitigation and protection for both Coastal Accommodations and Guest and will cover unintentional damages up to a maximum amount of $1,500.00. Notwithstanding the foregoing, Guest shall be responsible for any and all damages caused by Guest’s gross negligence or intentional or willful misconduct and any damages that exceed $1,500.00, and Guest expressly authorizes Coastal to charge the primary credit card on file or any other type of credit card provided for payment hereunder in order to recover such damages.

Guest shall immediately notify Coastal Accommodations of any accidental or unintentional damages to the Property prior to departure.  Guest’s acknowledging that the same have occurred to the Property during Guest’s stay will NOT BE REFLECTED ON ANY TYPE OF CREDIT REPORT but allows Coastal to repair, replace, or restore the damaged items under the aforementioned rental damage protection plan to the extent applicable.

All of the Property is NON-SMOKING. If Coastal determines, in its reasonable discretion, that there has been smoking on any part of the Property, the Guest will be charged an air quality fine of up to $1,500.00 in addition to any other costs incurred by Coastal Accommodations to clean the Property from smoke damage, which fine and damages may be charged against the primary credit card on file or any other type of credit card provided for payment hereunder.

HOUSEKEEPING AND OTHER CHARGES

The Rental Rate does NOT include daily maid service (unless otherwise noted), gratuities, car rental, food, liquor, personal items, excessive cleaning upon departure (i.e. upholstery or rug shampooing, etc.). Coastal is happy to provide quotes as a part of concierge services for any extra requests. Additional housekeeping [outside of the originally charged cleaning fee upon booking] starts at $90.00 per visit. The cleaning fee for all houses includes cleaning upon guests' departure along with towel and linen rentals for the duration of the rental timeframe. 

If Coastal’s housekeeping staff has to spend extra time cleaning the Property due to negligence, pet hair/damage, or for any other reason, Coastal has the authority to charge guests an additional cleaning fee of up to $300.00. This is a rare occurrence and only applicable should the guest be very negligent. If the rental term is in excess of thirty (30) days, Coastal urges guests to consider a monthly or bimonthly cleaning service, which Coastal offers to the Guest at $90.00 per visit.

WHAT WE PROVIDE

The Property comes fully equipped with television(s), private parking, laundry, linens, towels, dishes and utensils and an initial supply of shower essentials and paper goods. Coastal provides two towel sets per bedroom and a starter kit inclusive of toilet paper, a paper towel roll, a few trash bags, shampoo, conditioner, soap, lotion, bed linens, iron, ironing board, cookware, china, silverware, WiFi, basic cable, board games, vacuum, laundry detergent, dishwasher detergent, dish soap, and hand soap. CONDITION OF PROPERTY

Guest acknowledges and agrees that the Property shall be deemed to be clean and habitable, and its appliances and systems in good working order and operating condition unless, within six (6) hours of the Check-In Date, Guest shall notify Coastal of any deficiencies in the condition of the Property. Should Guest fail to provide such notice as provided herein and within the time specified herein, the Property shall be deemed to be habitable and acceptable to Guest and all appliances and systems shall be deemed to be in good working order and operating condition as of the Check-In Date. Guest acknowledges and agrees that no representation, statement, or warranty has been made by Coastal as to any condition or improvement of the Property.

Guest agrees to use the Property only for the purpose for which it is rented herein and in accordance with this Agreement, it being understood that the Property shall be in substantially the same condition upon the Check-Out Date as at the Check-In Date, normal wear and tear excepted. Guest further covenants and agrees to maintain the Property in a clean, orderly, safe, and sanitary condition, free of trash, junk, pet excrement, refuse, nuisances, or conditions that threaten or tend to threaten the health or safety of anyone, and in a manner or condition which is aesthetically pleasing. Guest shall cook only in areas specifically designated for cooking. Guest shall not permit any use of the Premises which is inconsistent with or contrary to this Agreement, the Terms and Conditions, or is illegal and expressly agrees to abide by the rules and regulations of any condominium association or third-party property manager, as applicable. Guest will rinse feet of sand prior to entering the Property.

MAINTENANCE

Guests understand and agree that Coastal cannot guarantee against mechanical systems or appliance failure during the rental term; however, Coastal will make every reasonable effort to have repairs completed efficiently. Guest expressly covenants and agrees to notify Coastal immediately upon the occurrence of any damage to the Property or discovery of any condition on the Property which Guest believes is unsafe or is in need of repair. Coastal has a maintenance team available for any repairs or emergency calls in the event of damage or any failure in the operation of the Property’s appliances and systems. 

ACCESS

Guest agrees to allow access to the Property to Coastal and its agents to perform maintenance and make repairs upon twenty (24) hours’ notice by telephone or in-person; provided, however, in the event of a fire or other emergencies, Coastal may enter the Property without such notice. Agents include but are not limited to, plumbers, electricians, rental companies, pest inspection, and the like and the Guest agrees not to deny access thereto. In the event that Guest refuses to allow access to Coastal or any agent designated by Coastal, Coastal reserves the right to terminate this Agreement and Guest will immediately vacate the premises upon demand by Coastal and will forfeit the rents and fees paid hereunder.

FAMILY-FRIENDLY POLICY

Coastal has a family-friendly group policy where we require guests to be not less than twenty-seven (27) years of age to enter into this Agreement and receive keyless entry instructions. The Property is not available for rent to high school or college party groups, including, without limitation, fraternities or sororities, unless otherwise approved prior to booking. By signing this Agreement, the Guest represents and warrants that it meets the requirements set forth herein, is qualified to rent the property, and shall not use the Property for any of the aforementioned prohibited uses. Misrepresentation by Guest may result in eviction by Coastal.

PET POLICY

To the extent this Property allows pets, the following terms apply:

Coastal has the authority to use its discretion in regards to determining whether or not any particular pet may be permitted on the Property. Guest agrees that no vicious or dangerous animals shall be permitted on the Property and no excessive barking, jumping, scratching, whining or any other loud sound shall be permitted on the Property. Guest must be able to control any pet at all times and such pet must be restrained (leash) at all times when not in the dwelling. Any odor resulting from any pet is considered a nuisance and is strictly prohibited. Guest assumes all responsibility and is strictly liable for any and all amount of any injury to any person or property as a result of any pet or its actions and Guest shall hold harmless and indemnify Coastal for all costs and damages, including costs of litigation and attorney's fees, resulting from the same. No pet is permitted to urinate or defecate on any unprotected floor and the Guest agrees to clean up after dogs immediately and properly dispose of all waste into a nearest outdoor trash receptacle. Guest is responsible for cleaning up all exterior areas. The guest may not abandon the pet or leave it for an extended period of time. Guest understands that these terms are subject to change as deemed necessary by Coastal. A non-refundable pet fee of $90.00 (plus tax) will be required for pets. Please use the couch covers if pets plan on using the furniture. Guest expressly agrees that it shall be responsible for any damages incurred as a result of Guest’s pet, including any urination smell and associated costs of cleaning or ruined furniture and associated repair or replacement costs. Please note, if housekeeping requires extra washing of bedding due to hair coverage, Coastal has the right to charge Guests for such costs. To avoid such charges, please keep pets off the furniture and bedding unless on a towel or blanket.

All pets MUST be flea-free. Please initial here to confirm your pet is up to date on flea medication. If any stay results in flea infestation, the Guest is liable for the cost of cleaning and pest control services rendered.

EVENTS AND CITY ORDINANCES

The Property is in close proximity to its neighbors and, as a result, it is important that all guests adhere to the city quiet hours, which are between 10:00 PM and 8:00 AM. No gatherings of any kind in excess of the occupancy of the Property as specified herein, including any parties, catering or outside musical performers or entertainment shall be allowed at the Property without the prior consent of Coastal (for which additional charges may apply). Coastal prefers you hold large dining gatherings, events and get-togethers elsewhere. Caroline has eight years of event planning experience and she is happy to help facilitate any planning and advice on affordable, available venues as alternatives to the Property.

LIMITATION OF LIABILITY

Under no circumstances shall Coastal be responsible for any loss, expense, damages, claims or injury direct, indirect, consequential or otherwise whatsoever, howsoever caused or incurred whether arising in contract or otherwise in law or equity as a result of rendering of the services or accommodations as described herein or substituted and including, without restricting the generality of the foregoing, as a result of any delay(s), substitution(s), rescheduling(s) or change(s) in the provision of services or accommodations by Coastal or by reason of military actions, revolution or acts of God, government agencies, pandemics, or unforeseen circumstances or events, by any agents, owners, employees, subcontractors, servants or services as substituted; Coastal at all times will act in good faith and use its best efforts to substitute with accommodations or services of a type as comparable as possible to those contracted. Coastal will not be liable under any circumstances, including substitutions, to refund any unused portion of booked accommodations or services.

Guest agrees to indemnify and hold harmless Coastal for any liabilities, theft, damage, cost, or expense whatsoever arising from or related to any claim or litigation which may arise out of or in connection with Guest’s use & occupancy of the Property, including, but not limited to, any claim or liability for personal injury or damage or theft of property which is made, incurred or sustained by Guest and acknowledges that Coastal would not rent the Property unless the Guest accepted this condition. Guest shall be liable for all acts of its family, invitees, employees, or other persons invited onto the Property. Guest understands that there are certain inherent risks to person and property located near the ocean, including the possibility of drowning.

Some activities in which guests engage are especially dangerous and include scuba diving, snorkeling, deep-sea fishing, boating, golfing, swimming, boogie boarding, surfing, hiking, biking, and mountain climbing. This list is not all-inclusive but indicates some of the hazards of vacationing in Virginia Beach. Guests may also encounter the following risks: slippery floors and stairs, especially when wet, lanais with spaces between rails (dangerous for little children), precipitous drop-offs on ocean floor, unfenced pools, faulty electrical or plumbing systems, gas BBQ grills, clean/clear sliding glass doors, and dangerous stairs or pathways, Therefore, each guest agrees that he/she is voluntarily participating in any and all activities, risks, and use of the accommodations, and hereby assumes all risk of injury, illness, damage or loss to person and property that might result, including, without limitation, any loss or theft of personal property.

EVICTION

Coastal reserves the right to cancel or rescind this Agreement if it is found that Guest is conducting unlawful activities, not abiding by the Terms and Conditions, disturbing others by playing loud music, percussion, audio or instruments, or cause any loud or offensive noises, has made any misrepresentations about the nature or size of its group or the use of the Property or is otherwise in breach of this Agreement. Upon notice of termination of this Agreement, Guest shall vacate the Property immediately and forfeit all rents. In such an event, Coastal may evict Guest immediately, at the sole cost and expense of Guest.

ASSIGNMENT AND SUBLETTING

Guest shall not assign or transfer this Agreement, or the tenancy created hereby, nor sub-lease the Property, in the absence of prior written approval by Coastal, which authorization may be withheld in Coastal’s sole discretion.

HOLDOVER, ABANDONED POSSESSIONS AND SERVICE OF NOTICES

If Guest continues to occupy the Property, without written permission, after the expiration of the rental term, Guest shall become a holdover tenant and shall be liable for rent at twice the Rental Rate under the Agreement on a prorated daily basis for each day of such holdover tenancy.

If Guest leaves any personal property, which Coastal, in its sole discretion, determines to be of value, Coastal shall contact Guest by mailing a notice to Guest’s last known address. If Guest fails to respond within twenty (20) days of delivery of such notice, Coastal may advertise the items for sale or donate them to a charitable organization. By delivering notice to Guest, Coastal shall be deemed to have delivered notice to any occupant of the Property during the rental term. Notwithstanding the foregoing, Coastal shall have no liability or responsibility for Guest’s personal belongings or property.

CANCELLATION AND REFUNDS

Cancellation of reservation at any time after acceptance of this Agreement by Coastal may result in forfeiture of the Rental Deposit as follows:

(i) Guest shall be refunded the full amount of the Rental Deposit in the event of cancellation more than sixty (60) days prior to the Check-In Date;
(ii) Guest shall be refunded 50 percent of the Rental Deposit in the event of cancellation on or after the sixtieth (60th) day prior to the Check-In Date, but more than thirty (30) days prior to the Check-In Date; or
(iii) Guest shall not be entitled to any refund of the Rental Deposit in the event of a cancellation on or after the date that is thirty (30) days prior to the Check-In Date.

Under specific circumstances, at is sole and absolute discretion, Coastal may negotiate these terms; provided, however, there should be no expectation of refund or relocation due to any mechanical or systems failure or service interruption to the Property.

PLEASE CONSIDER PURCHASING SUN TRIP PRESERVER TRAVEL INSURANCE. This will insure any unforeseen cancellations covered under the premium, such as illness, death, travel interruptions, and so forth. 

CATASTROPHIC EVENTS & EMERGENCY EVACUATIONS

If a catastrophe, act of God or another event of forced Majeure (hurricane, tornado, earthquake, flood, fire, the act of war, insurrection, rebellion, pandemic, etc.) or any situation simply beyond Coastal’s control impairs the vacation rental, Coastal is not responsible for finding alternate lodging for the renter or for the renter's financial losses related to transportation or alternate lodging. There will be NO REFUNDS OR CREDITS FOR EMERGENCY EVACUATIONS. The threat of a hurricane, flood, or tsunami is always present during certain months of the year in Virginia Beach, Virginia, and Guest expressly assumes this risk by entering into this Agreement. Coastal suggests Guest consider Travel Protection Insurance to secure their vacation investment and mitigate financial risk. There will be no refunds of any kind for evacuations.

ACKNOWLEDGEMENT

Guest, the undersigned, hereby applies for the above-listed Property and warrants that Guest has read, understands, and agrees to the terms and conditions of this Agreement, and agrees to abide by Terms and Conditions with respect to the use of said Property. Guest agrees that this is a legally binding document and acknowledges that Guest has been advised, and has had the opportunity, to seek legal counsel.
